| 6 | 6 Minute Entry for proceedings held before US Magistrate Judge Giselle Lopez-Soler: Waiver of Indictment, Filing of Information and Plea Hearing as to Jorge A. Fuentes-Delgado (1) held on 6/23/2021 via VTC. Present were AUSA Scott Anderson, Atty. Edwin Leon and USPO Jorge Mateo. Defendant was present O/B and assisted by a certified court interpreter. The defendant waived his right to appear physically at the hearing and consented to proceed by way of VTC. Defendant waived his right to be prosecuted by an indictment and consented to proceed before a USMJ. The defendant was found competent to plead. Information was filed and assigned Cr. 21-221 (GAG). The defendant was advised of the charges contained in the information and advised as to his rights. The defendant was also advised of the applicable minimum and maximum statutory penalties that he is exposed to. The Defendant informed the Court that he has retained the services of Counsel Edwin Leon-Leon. Pursuant to the Due Process Protections Act, Pub. L. No. 116-182, 134 Stat. 894 (Oct. 21, 2020) and Rule 5(f) of the Federal Rules of Criminal Procedure, the United States is reminded of its obligation to disclose in a timely manner all exculpatory evidence to the defendant[s], that is, all evidence that is favorable to the defendant[s] or tends to cast doubt on the United States case, as required by Brady v. Maryland, 373 U.S. 83 (1963) and its progeny. Failure to comply with this order may result in consequences, including, but not limited to, the reversal of any conviction, the exclusion of evidence, adverse jury instructions, dismissal of charges, contempt proceedings, disciplinary action, and/or sanctions by the Court. As to bail, the Government didn't move for detention, defense counsel requested release. After hearing the parties, the Court adopted the Pretrial Services recommendation and ordered the defendant to be released on his own recognizance and set bail at $10,000 of which $3,000 are secured and $7,000 unsecured. Defendant has 10 days to post the secured portion. Also, the defendant shall submit to the Clerk's Office the receipt of weapons seized and surrender travel documents. As to the plea hearing, the defendant was advised of the maximum penalties he is facing, his constitutional rights, the consequences of waiving his constitutional rights and the applicable statutory guidelines. Having heard the parties, the Magistrate Judge will recommend to the Court that the plea of guilty be accepted as to Count One (1) of the Information. A Report and Recommendation will be issued. PSI report is ordered. Sentencing Hearing set for 9/21/2021 at 9:00 AM in VTC Bridge GAG before Judge Gustavo A. Gelpi. (Court Reporter ZoomGov Recording.) Hearing set for 10:00.
