Heights Finance Holding Company, 6:26-cv-03564-TMC, (ECF No. 6 ); Smith v. Heights Finance Holding Company, 6:26-cv-03567-TMC, (ECF No. 10 ); Malone v. Heights Finance Holding Company, 6:26-cv-03568-TMC (ECF No. 7 ); Patterson v. Heights Finance Holding Company, 6:26-cv-03579-TMC (ECF No. 7 ); Huston v. Heights Finance Holding Company, 6:26-cv-03592-TMC (ECF No. 5); Titus v. Heights Finance Holding Company, 6:26-cv-03594-TMC (ECF No. 7 ); Waitkus v. Local Civil Rule 7.02 requires all non-exempt motions to "contain an affirmation by the movant's counsel that prior to filing the motion he or she conferred or attempted to confer with opposing counsel and attempted in good faith to resolve the matter contained in the motion." Here, counsel for the moving parties attests that "counsel for Defendant have been consulted concerning this Motion and have indicated that the relief sought in unopposed by Defendant." However, no attorney has entered an appearance on behalf of Defendant in any of these actions and a corporate entity may not proceed pro se in this litigation and may only appear through legal counsel. See Rowland v. California Men's Colony, 506 U.S. 194, 202 (1993). The Court seeks clarification as to consultation under Rule 7.02 in this case. Plaintiff's counsel is directed to file a short explanation within seven (7) days detailing how and from whom Plaintiff's counsel was informed that Defendant is not opposing the instant motion, accompanied by related documentation if available.
